This policy applies to the purchase or hire of a Giant Inflatable Snow Globe, Cash Grabber, or Bespoke Inflatable Globe (the “Product”), whether supplied on a manned or unmanned basis, and whether used indoors or outdoors.
We may revise this policy at any time without notice. We recommend that you check this page regularly. It was last updated on 18 October 2017.
1. Statutory Rights
1.1 Nothing in this policy affects your statutory rights under the Consumer Rights Act 2015.
1.2 The Product will be supplied:
- as described
- of satisfactory quality
- fit for the purpose expressly agreed at the time of purchase or hire
1.3 This policy explains the limits of that purpose and clarifies circumstances that do not constitute a lack of conformity under the Act.
2. No Refunds Due to Weather
Weather conditions, including rain, wind, moisture, cold temperatures, or seasonal conditions, do not give rise to any right to a refund, price reduction, or rejection of the Product, where the Product:
- has been delivered, installed, collected, or used; and
- was supplied as described and in satisfactory condition at the time of supply.
Adverse weather does not make the Product defective, faulty, or not fit for purpose within the meaning of the Consumer Rights Act 2015.
3. Description of the Product
3.1 The Product is an inflatable structure manufactured from stitched PVC materials and maintained by continuous airflow.
3.2 The Product is not described, marketed, or sold as waterproof or weatherproof.
3.3 The stitched construction means that water ingress along seams and joins is an inherent and foreseeable characteristic of the Product.
This forms part of the Product’s description for the purposes of the Consumer Rights Act 2015.
4. Fitness for Purpose
4.1 The Product is fit for the purpose of temporary display and interaction, including outdoor use, subject to appropriate weather conditions and correct operation.
4.2 The Product is not fit for the purpose of use in sustained rain, heavy rain, flooding, or extreme weather, and no such purpose is implied or accepted.
4.3 Any use outside the purpose expressly agreed, including use during unsuitable weather conditions, constitutes use at the client’s own risk.
5. Light Rain & Normal Moisture Transfer
5.1 When fully inflated and operational, light rain will generally run off the external surfaces.
5.2 Internal moisture transfer during light rain is normal, foreseeable, and inherent in inflatable structures.
5.3 Such moisture does not indicate that the Product is:
- defective
- unsatisfactory
- incorrectly supplied
- not fit for purpose
for the purposes of the Consumer Rights Act 2015.
6. Deflation, Shutdown & Water Pooling
6.1 If the Product is switched off or deflated while exposed to rain, water will collect within the gathered material.
6.2 In such circumstances, the client is responsible for placing a suitable waterproof cover over the Product.
6.3 Water ingress or damage arising from deflation or shutdown in wet conditions results from operation and environmental exposure, not from any defect in the Product.
7. Heavy Rain & Extreme Weather
7.1 During heavy rain or extreme weather, water ingress may occur even while the Product remains inflated.
7.2 This risk is inherent, foreseeable, and unavoidable when using non-sealed inflatable equipment outdoors.
7.3 Exposure to such conditions does not mean the Product was not of satisfactory quality or not fit for its agreed purpose.
8. Internal Contents & Contamination
8.1 Any internal items, including artificial snow or decorative materials, that become wet or contaminated must be removed and disposed of.
8.2 Such contamination arises from environmental exposure and does not indicate a defect in the Product.
8.3 Replacement of contaminated contents is not included and is chargeable.
9. Acceptance, Use & Post-Use Claims
9.1 Once the Product has been used, this constitutes acceptance that it was supplied in conformity with the terms.
9.2 Claims made after use alleging unsuitability due to weather conditions shall not entitle the client to reject the Product or claim a refund where the Product was correctly supplied.
9.3 Weather-related inconvenience, interruption, or additional drying requirements do not give rise to remedies under the Consumer Rights Act 2015.
10. Burden of Proof
10.1 Where a claim is made that the Product was defective, the burden of proof rests with the client.
10.2 Moisture ingress, contamination, or weather-related effects shall be presumed to arise from environmental exposure or operational decisions, not from any lack of conformity, unless proven otherwise.
11. Best Practice Recommendation
11.1 For outdoor use, particularly during winter months or where rain is forecast, it is strongly recommended that the Product is installed under a suitable weather-protective structure such as a marquee.
11.2 Failure to follow this recommendation does not create liability for The Giant Snow Globe Ltd.
12. Governing Law & Jurisdiction
12.1 These terms are governed by the laws of England and Wales.
12.2 The courts of England and Wales have exclusive jurisdiction.
By purchasing or hiring the Product, you acknowledge that you have read, understood, and agreed to these Terms.
